These Terms of Use (“Terms”) govern your access to and use of the websites, online store, and related services provided by Jenn’s Art Studio (“we,” “us,” or “our”) (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase. By using the Services, you represent that you meet these requirements.

You may need an account to access certain features. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

All purchases are subject to acceptance and availability. We may refuse or cancel an order for any reason, including suspected fraud, product availability, or errors in pricing or product descriptions.

Prices are listed in USD unless stated otherwise. Taxes, shipping, and handling may be added at checkout.

Payments are processed by third-party payment processors. Your payment information is handled according to their terms and privacy practices.

From time to time, we may offer promotions, discount codes, coupons, or store credits (“Promotions”). Unless otherwise stated:

• Promotions have no cash value and cannot be redeemed for cash.
   
• Promotions may be limited to one per order and may not be combined with other offers.
   
• Promotions may exclude certain items, including original artworks, commissions, custom work, or limited editions, as noted on the product page or at checkout.
   
• Promotions may have an expiration date and may be limited by quantity or time.
   
• We reserve the right to modify, suspend, or cancel any Promotion at any time, including when we believe there has been misuse, fraud, or error.
   
• If an order is canceled or refunded, any Promotion applied to that order may be voided.
   

Shipping timelines are estimates and not guaranteed.

All original artworks, commissions, and custom work are final sale. No returns or refunds.

For tote bags, posters, and prints, we offer damage/print-issue support only:

• You must contact us within 15 days of purchase if your item arrives damaged or has a print defect.
   
• To request a replacement or resolution, email jenniferverdieuart@gmail.com and include:
   
  • Your order number
     
  • Clear photos of the item
     
  • Photos of the packaging (if damage occurred during shipping)
     

If approved, we will provide a reasonable resolution, which may include a replacement (when available) or another solution at our discretion. Shipping costs are generally non-refundable unless required by law.

Minor variations consistent with handmade or limited-run production are not considered defects.

Many of our products are made in small batches, may be limited edition, and/or are handmade. As a result:

• Natural variation is normal. Colors, textures, scale, placement, or minor details may vary slightly from item to item, especially for handmade, studio-produced, or limited-run pieces.
   
• Screen and lighting differences. We cannot guarantee that your device’s display will accurately reflect the true colors of the product.
   
• Print and production differences. Slight differences in trimming, border size, paper texture, ink density, or material weave may occur and do not constitute a defect.
   
• Edition and availability. If an item is listed as “limited edition,” availability may change at any time and editions may sell out without notice.
   
• What counts as a defect. We consider defects to include significant printing errors, major damage on arrival, or manufacturing issues that materially affect the product’s intended appearance or use—subject to our 15-day damage/print-issue policy described above.
   

All content on the Services—including artwork images, designs, logos, text, graphics, photos, and website content—is owned by Jenn’s Art Studio or its licensors and is protected by intellectual property laws.

You may not copy, reproduce, distribute, publicly display, modify, create derivative works of, or exploit any content without our prior written permission, except for personal, non-commercial use.

If you submit content (such as reviews, comments, photos, or testimonials), you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content for operating and promoting our Services. You represent you have the rights to post it and it does not violate any laws or third-party rights.

We may remove user content at our discretion.

You agree not to:

• Use the Services for any unlawful purpose
   
• Attempt to access accounts or systems without authorization
   
• Interfere with the security or operation of the Services
   
• Scrape or use automated tools to extract content without permission
   
• Post content that is defamatory, harassing, hateful, or infringing
   
• Use our artwork/images to create counterfeit products or competing listings
   

The Services may contain links to third-party websites or tools (e.g., payment processors). We are not responsible for third-party content, policies, or practices.

The Services are provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law.

Color/Display Disclaimer: Product colors and textures may vary due to screen settings, lighting, and printing/material differences.

To the fullest extent permitted by law, Jenn’s Art Studio will not be liable for indirect, incidental, special, consequential, or punitive damages.

In any event, our total liability for any claim will not exceed the amount you paid us for the applicable purchase (or $100 if no purchase was made), unless otherwise required by law.

You agree to indemnify and hold harmless Jenn’s Art Studio from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your infringement of any rights of another person or entity.

We may suspend or terminate your access to the Services at any time if we believe you violated these Terms or if required for security or legal reasons.

These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles.

Any dispute arising from these Terms will be brought in the state or federal courts located in New York County, New York, and you consent to jurisdiction and venue there.

We may update these Terms from time to time. If we make changes, we will post the updated Terms and update the “Last Updated” date. Your continued use of the Services after changes means you accept the updated Terms.
